Welcome to ChhakdaWala (“Company”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of our website, mobile application, and services (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Platform.

1. Definitions

  • “User / Customer”: Any individual or business booking deliveries through the Platform.
  • “Driver / Partner”: Chhakda owners or drivers registered with ChhakdaWala.
  • “Service”: Industrial material delivery, transport, pickup, and related logistics support.
  • “Platform”: Website, mobile app, dashboard, and backend systems.

2. Eligibility

You must be:

  • At least 18 years old, and
  • Capable of entering into a legally binding contract under the Indian Contract Act, 1872.

Businesses using the platform must be authorized to make bookings in the company’s name.

3. Nature of Service

  • ChhakdaWala is an aggregator platform connecting customers with independent Chhakda drivers for goods transportation.
  • We do not own the vehicles.
  • Drivers operate as independent contractors.
  • The contract of service is between Customer & Driver, facilitated by ChhakdaWala.

4. Booking & Service Terms

When using our platform:

  • You agree to provide accurate pickup/drop details.
  • Delivery charges include time, distance, load type, and waiting charge.
  • The driver may refuse service if goods are unsafe, illegal, or overweight.
  • Users must ensure goods are properly packed.

ChhakdaWala reserves the right to:

  • Cancel bookings for operational or safety reasons.
  • Assign or reassign drivers as needed.
  • Change pricing dynamically during peak hours.

5. Prohibited Goods

The Platform cannot be used to transport:

  • Illegal, stolen, or banned items under Indian Penal Code or NDPS Act.
  • Hazardous chemicals or explosives.
  • Currency, jewelry, or high-value items without disclosure.

Drivers may decline such goods.

6. Payments & Billing

  • Users agree to pay the delivery charges displayed in the app.
  • Payments may be made via UPI, wallet, card, cash, or monthly billing (for corporate users).
  • All charges are inclusive/exclusive of taxes as applicable under GST laws.
  • Invoices shall be issued digitally.

7. Cancellation & Refund Policy

  • Users may cancel bookings before the driver reaches pickup location.
  • Cancellation fee may apply depending on distance traveled by driver.
  • No refund applicable after the driver begins loading goods.
  • Refunds (if any) take 3–7 business days.

8. Liability & Limitations

8.1 Damage to Goods

  • ChhakdaWala is not liable for damage due to improper packing, loading, or weight imbalance.
  • Drivers are responsible for safe handling once goods are properly packed.

8.2 Service Delays

ChhakdaWala is not responsible for delays caused by:

  • Traffic, weather, accidents, or vehicle breakdown.
  • Government restrictions or strikes.
  • Other events outside reasonable control.

8.3 Indirect Loss

Under Indian law, ChhakdaWala is not liable for indirect, incidental, or consequential damages including:

  • Business loss
  • Production delay
  • Loss of profits

9. User Responsibilities

You agree NOT to:

  • Misuse the platform
  • Post false information
  • Abuse drivers or staff
  • Engage in illegal activities
  • Try to reverse-engineer the app

Violation may lead to account suspension.

10. Driver Responsibilities

Drivers must:

  • Hold valid driving license
  • Maintain vehicle fitness
  • Follow traffic laws
  • Not overcharge users
  • Maintain professional behavior
  • Deliver items safely

11. Data Protection & Privacy

Your data is processed in accordance with the Information Technology Act, 2000, and the Digital Personal Data Protection Act (DPDP Act), 2023. Refer to our Privacy Policy for details on data usage.

12. Intellectual Property

All logos, designs, app UI, text, software, and trademarks belong to ChhakdaWala. Unauthorized copying or reuse is prohibited under Indian Copyright Act, 1957.

13. Termination of Service

We may terminate or disable your access if:

  • You violate any terms
  • Engage in fraud
  • Misuse platform for illegal activities

You may delete your account anytime.

14. Governing Law

These Terms are governed by the laws of India. Jurisdiction: Rajkot, Gujarat (or your chosen city).

15. Dispute Resolution

Any disputes shall be resolved through:

  • Internal grievance redressal
  • Mediation/Arbitration under the Arbitration & Conciliation Act, 1996
  • Courts of competent jurisdiction (Rajkot)

16. Amendments

ChhakdaWala may update these Terms anytime. Continued use means you accept the updated Terms.
